Domena z literówką uznana za obraźliwą

Cześć,

Zwracam się do Was z pewnym problemem, który mi się niedawno przytrafił. Mianowicie chodzi o domenę http://rheladbible.com, która jest literówką domeny http://theladbible.com.
Sprawa wygląda tak, że domena była zaparkowana na Sedo, natomiast tydzień temu dostałem maila od Theladbible, że domena została uznana przez nich za obraźliwą. Dodatkowo napisali, że nie chcą zgłaszać tej sprawy swoim prawnikom, i że mam oddać domenę w ich własność.
Napisałem do nich maila na adres, który podali, lecz adres ten nie istnieje, więc to zignorowałem. Dziś znowu dostałem od nich wiadomość, że nie odpowiedziałem na ich maila i jeśli nie oddam domeny w ich własność, to przekażą sprawę prawnikom.

Co powinienem zrobić?

We’ve noticed that you have registered the domain name rheladbible.com which is resolving to an active website.

 

We’re flattered that you like our brand, but obviously we cannot let your use continue as we consider this to be an abusive domain.

 

We don’t want to get our lawyers involved, and we won’t provided that you immediately transfer ownership of this domain over to us.

If we don’t hear back from you on this by 27th February 2017 then we will have no choice but to pursue this formally with our lawyers.

Zapytaj czy zwrócą Ci koszty rejestracji i utrzymania...bo jak na razie to próbują domenę wyłudzić.

Nie chodzi o to, że jest obraźliwa ale, że narusza ich prawa ze względu na podobieństwo do ich nazwy.

 

WHAT IS ABUSIVE REGISTRATION?

 

To successfully make a complaint using our Dispute Resolution Service (DRS) you must be able to prove the domain name, in the hands of the current registrant, is an abusive registration. This means you must be able to prove the domain name either:

 

Took unfair advantage of or was unfairly detrimental to your rights at the time of registration or acquisition; or

Has been used in a manner which took unfair advantage of, or was unfairly detrimental to your rights.

This means that the unfair conduct can happen at any point during the lifetime of the domain name, from registration onwards. The DRS doesn’t require that both the registration and use of the domain name be unfair. It’s also important to note that unfair use of a domain name covers use for any purpose, such as for a website or email.

 

For example, it could be that the registration was ‘fair’ (because the parties agreed at the time, or did not object), but the use later becomes unfair – because there is a change of use, a falling out between the parties, or a change of motive.

 

EXAMPLE OF ABUSIVE REGISTRATIONS

 

Not quite sure what constitutes an abusive registration? Take a look at these examples included in our DRS Policy:

 

The domain name was registered with the primary purpose of selling or renting it specifically to the Complainant (or a competitor) for more than the Respondent paid for it

The domain name was registered with the primary purpose of stopping the Complainant using it

The domain name was registered with the primary purpose of disrupting the Complainant’s business

The domain name has been used to confuse internet users

The list above isn’t exhaustive, and you may have another reason to make a complaint.

 

EVIDENCE THAT A REGISTRATION IS NOT ABUSIVE

 

In our DRS Policy, we also give some examples of factors that may show the registration is not abusive, including:

 

The respondent can show they have made preparations to use the domain name for a legitimate business

The domain name is generic or descriptive and is being used fairly

The domain name is being used purely for tribute or criticism

Again, this list is not exhaustive and respondents may raise other arguments to defend their registration of a domain name.

W kontekście domen ang. wyrażenie "abusive" oznacza, że zarejestrowałeś domenę "w złej wierze" i z obraźliwością nie ma to nic wspólnego. Czyli chcesz wykorzystać domenę w niecnym celu, właśnie jako literówka na przykład. W związku z tym w pełni uzasadnione jest pisemko. To chyba jakaś śmieciowa domenka, więc nie ma o co kruszyć kopii. Trzeba tylko sprawdzić, czy rzeczywiscie za mailem stoi ktoś od nich, a nie osoba trzecia i dać sobie siana. Może być też tak, że tylko straszą, że niby za nimi stoi sztab prawników. Jeśli masz czas i nerwy, żeby to sprawdzić, go ahead! Powodzenia. Zaraz też dostaniesz od kogoś dobrą radę, żeby wystawić domenę na sedo z niewielką ceną np. 200 USD i czekać.
